National Physical Evaluation Boards (PEBs) Lawyer

Fighting for Veterans Rights | International Medical Evaluation Boards Attorney

Evaluations by military medical evaluation boards (MEBs) and physical evaluation boards (PEBs) can determine the course of a military member's career and the degree to which he or she will receive — or will not receive — future military benefits.

The Law Offices of David P. Sheldon, in Washington, D.C., represents actively serving and former military members who believe they received incorrect determinations from a PEB. We help them prove their true conditions for admittance to the military, military promotions, eligibility for long-term disability benefits and other needs.

The responsibility PEBs bear is heavy and important. Nevertheless, these boards frequently make mistakes. The consequences can be devastating. An incorrect PEB can:

  • Prevent or derail a service member's career by deeming that person unfit to perform a role for which he or she is qualified or capable
  • Damage a service member by declaring him or her fit to perform duties for which the person is no long physically, mentally or emotionally fit to perform (such as active service in a war zone)
  • Incorrectly or intentionally assign a disability rating that prevents a disabled military member or veteran from receiving appropriate medical coverage or long-term disability benefits
  • Deny medical coverage or long-term disability benefits to a service member by declaring his or her serious injury or condition to be "pre-existing"

Military Doctors Make Mistakes | Get Justice Through Our National Physical Evaluation Boards (PEBs) Attorney

Military physicians often fail to do a full-body analysis, focusing their examinations too narrowly to accurately assess an injury.

If you believe your PEB is wrong, our medical evaluation board lawyer, David Sheldon, can make your case for appealing the decision. From the point of referral to a Medical Evaluation Board (MEB) and continuing through the informal and formal PEB evaluations, Mr. Sheldon will work to see that you receive the determinations you deserve.

Retain Mr. Sheldon, and he will arrange an independent medical exam to obtain a complete analysis to rebut the MEB's finding. In some cases, this information can mean the difference between a one-time financial settlement and full disability benefits for life.

The MEB/PEB Process

Once the MEB is final, the case is referred to an informal "paper" hearing.

A soldier, sailor or airman can obtain a fair hearing at this level and at times avoid having to proceed to a formal PEB. This can be a critical stage for the member to have counsel.

If a formal "on the record" hearing is elected, Mr. Sheldon will present the case both in person and with a formal memorandum detailing why the military member should be rated under both the particular service's regulations and the Veterans Administrations Ratings for Disabilities.

Once the decision is made at the formal PEB, the military member can elect to submit a Petition for Relief. If this is denied, the member can apply to the Correction Board as an appeal of last resort. The service member should take care to exhaust all of his or her remedies so that a clear and substantial record can be made.

At each step, Mr. Sheldon will advise service members of the best tack to take in advancing the case.
