After the court-martial, your case is not over. You have the right to submit post-trial matters to the convening authority, which may include a request for clemency and identification of legal errors you believe were committed during the trial. Additionally, depending on the sentence approved by the convening authority, you may have the right to an automatic appeal. This automatic appeal goes to your service’s Court of Criminal Appeals.

Unlike civilian appellate courts, military courts of criminal appeals have the ability to review the facts of your case, and if the appellate judges are not personally convinced of your guilt beyond a reasonable doubt, they can reverse the conviction! If you are dissatisfied with the results of your automatic appeal, you may petition the Court of Appeals for the Armed Forces, which consists of five civilian judges, to review your case.

Finally, you may also petition the United States Supreme Court. An accused with an approved sentence of death is entitled to two automatic appeals, one automatic appeal to the Court of Criminal Appeals, and a second automatic appeal to the Court of Appeals for the Armed Forces.

If your sentence is not severe enough to give you a right to an automatic appeal, you may still appeal your case to your service’s Judge Advocate General. In this situation, your case will be reviewed by a military lawyer working in the Judge Advocate General’s office. That lawyer may recommend to the Judge Advocate General that your appeal be denied, granted, or forwarded to your service’s Court of Criminal Appeals for review.
